1. Legal Notice

1.1 The website accessible at www.experimentalgroup.com (hereinafter the “Site”) is operated by Experimental Group, a simplified joint-stock company with a share capital of €20,100,900.00, registered with the Paris Trade and Companies Register under number 524 095 064, with VAT number FR48824023063, and whose registered office is located at 14-16, Boulevard Poissonnière, 75009, Paris, France (hereinafter the “Company”).

2. Acceptance of Terms of Use

2.1 This document defines the terms and conditions (hereinafter the “Terms of Use” or “TOU”) under which the Company allows users (hereinafter the “Users”) to browse and use the Site.
2.2 Using the Site implies full, complete, and unconditional acceptance of these TOU.

3. Use of the Site

3.1 Before using the Site, the User must ensure they have the technical and computer resources to navigate and use the Site and that their equipment is in good working order and free of viruses.
3.2 The Company reserves the right to modify, revise, delete, validate, or change, in whole or in part, any content (hereinafter the “Content”) on the Site at any time.

4. User Obligations

4.1 By using the Site, Users agree:
4.1.1 Not to use the Site illegally, for unlawful purposes, or in a manner incompatible with these TOU;
4.1.2 Not to post abusive, defamatory, harassing, obscene, pornographic, threatening content or violate others’ privacy;
4.1.3 Not to sell, copy, reproduce, rent, lend, distribute, transfer, sublicense, or allow third parties to access or use the Site, attempt to reverse engineer, decompile, or discover source code, or use software enabling access to any part of the Site;
4.1.4 To respect other Users;
4.1.5 Not to collect or store personal data of other Users;
4.1.6 Not to distribute content inciting crime, discrimination, racial hatred, or violating laws, public order, or good morals;
4.1.7 Not to distribute ideological, religious, political, or ethnic content;
4.1.8 Not to distribute content endangering minors, including violent or pornographic messages;
4.1.9 Not to mislead others by impersonating another person;
4.1.10 Not to post, transmit, or share content violating intellectual property rights or other proprietary rights of third parties;
4.1.11 Not to post unsolicited advertising, promotional material, or spam;
4.1.12 Not to use the Site abusively by introducing viruses or other malicious software and not to attempt unauthorized access;
4.1.13 Not to denigrate the Site, the Company, or other Users on social media or any communication channel.
4.2 If the Company considers that a User violates these TOU, it may, at its discretion, terminate access to the Site and take any action, including legal proceedings.

5. Accuracy and Legality of Information

5.1 Each User agrees that all information provided, especially personal information, is accurate, up-to-date, and complete and agrees to update it regularly.
5.2 The User acknowledges that the Company does not have the means to verify the accuracy of all information on the Site and cannot be held liable for identity theft or false information.
5.3 The Company does not guarantee the appropriateness, legality, integrity, or quality of information provided by Users.

6. Intellectual Property

6.1 By accessing the Site, Users acknowledge that the Site and its Content, including images, photographs, designs, graphics, drawings, layouts, logos, trademarks, and texts, are the exclusive property of the Company and protected under French intellectual property law and applicable international treaties. Reproduction without express authorization is prohibited and may result in civil and criminal liability.
6.2 The Company holds all rights, titles, and interests, including copyright, design rights, trademarks, trade names, domain names, technology, know-how, formulas, source code, executable code, and database rights.
6.3 The Company grants Users a non-exclusive license to use the Site and Content strictly in accordance with these TOU.
6.4 Reproduction, representation, adaptation, commercial use, distribution, translation, arrangement, transformation, or creation of derivative works is strictly prohibited and may constitute copyright infringement. Systematic extraction of Site information or Content is also prohibited and may result in civil and criminal liability.

7. Liability

7.1 The Company is not responsible for any damage resulting from unauthorized third-party access, alteration of Content, or harm to Users, and more generally for any damage caused by accessing or being unable to access the Site beyond its control.
7.2 The Company cannot be held responsible for technical failures related to telecommunications networks, online systems, servers, ISPs, User equipment, or software.

8. Links

8.1 Hyperlinks to other websites or external sources (hereinafter “External Sources”) are beyond the Company’s control. Users acknowledge that the Company is not responsible for External Sources or their content, advertisements, products, services, or other materials.

9. Trademarks

9.1 All trademarks and logos belong to the Company and are protected under French intellectual property law (hereinafter collectively the “Trademarks”). Users may not use or distribute the Trademarks without express written permission.
9.2 This prohibition extends to all signs reproducing the Company’s Trademarks, including trade names, commercial names, logos, domain names, and designs.

10. Personal Data Protection

10.1 Provisions regarding personal data protection are detailed in the Site’s Privacy Policy.

11. Governing Law and Jurisdiction

11.1 These Terms are governed by French law, without regard to conflicts of law provisions.
11.2 In case of a dispute regarding interpretation or execution of these TOU, the competent courts are those designated under the French Code of Civil Procedure.

12. Language

12.1 This terms are written in French. In the event of translation into other languages, the French version prevails in case of dispute.
